Terms and Conditions

 

Here is all the fine print that you need to know about Transfer Pricing Measurements services:

FACE TO FACE WORKSHOPS:

 

Payment Terms:

A tax invoice will be emailed on receipt of booking confirmation. Payment is due in full two weeks prior to course date. Payment can be made by electronic transfer, cheque or credit card.

Cancellation Policy:

If you are unable to attend a course for which you have registered, please contact Transfer Pricing Measurements as soon as possible by calling  +61 (0)402 597 280  or emailing at admin@transferpricingmeasurements.com

To obtain a full refund on a course, delegates must notify Transfer Pricing Measurements in writing at least ten business days (two weeks) prior to the workshop or event start date that they wish to transfer to an alternate date, or cancel. Delegates who transfer or cancel from a workshop or event inside two weeks from the start date shall forfeit the full program fee.  No refunds will be given in this instance, but if the online version of this course is available, this can be undertaken instead.  Substitutions can be made at any time (see below).

Substitutions:

Substitutions can be made, with prior notification in writing to Transfer Pricing Measurements, at any time up to the workshop or event start date, with no penalty.  Please contact us as soon as possible with the name of your substitute attendee so that we can arrange a certificate in their name.

Non Attendance:

If a delegate fails to attend a course, even in the case of illness, program fees will not be refunded or allocated to another course.

Cancellation or transfer notifications should be made in writing to admin at admin@transferpricingmeasurements.com

Please Note:  It is the responsibility of the registered person to ensure transfer or cancellation notifications are received by Transfer Pricing Measurements with at least two weeks’ notice.

General:

Please note that Transfer Pricing Measurements may change or cancel any class (but will offer you a full refund if the date or content of the course is not the same as the one that you booked on). If a course has been cancelled, you will be notified ten days prior to the scheduled course date or earlier.  We will not be held liable for any costs incurred by the attendee if a course is cancelled or postponed. If travelling interstate to attend a course, we recommend you book a flexible flight in the unlikely event of course cancellation or date change. Transfer Pricing Measurements reserves the right to modify course content or substitute presenters at its discretion.

Transfer Pricing Measurements’ course material is protected by copyright. The material must not be copied or utilised in any way other than for personal education purposes of the original delegate.

By registering for a workshop, you are consenting for Transfer Pricing Measurements  to send you information pertaining to your course, such as pre-course survey, venue and post-course support information.  Following the course we may send you other information very occasionally about other courses we think you might be interested in.  You can unsubscribe from this at any time.

Continuing Education:

A certificate of attendance will be awarded on completion of the course. Courses are not offered as vocational training and will not qualify you for any specific employment. Course credits are not transferable to any accredited educational institution.

If you are a member of a professional association, you may be eligible for Continuing Development Points (CPD) points.  Please enquire with your association as to whether a particular course satisfies any of your continuing educational requirements.

ONLINE COURSES:

The course fee must be paid prior to receiving course materials. Once materials have been accessed and downloaded, your course fee cannot be refunded, however, if you are not fully satisfied with the course content, please contact us within 48 hours of your first access for a full refund.

If you do not wish to pay by credit card, an invoice can be emailed to you and payment can be made alternatively by direct bank transfer or cheque.

We reserve the right to cancel or terminate a course or to refuse any enrolment as permitted by law.

The course materials are designed for individual student use. They are the intellectual property of Transfer Pricing Measurements and they cannot be copied, distributed or reproduced in any way except with the written permission of Transfer Pricing Measurements.

By registering for an online course, you are consenting for Transfer Pricing Measurements to send you information pertaining to your course, such as course details, reminders and support information.  During the course access period, emails will generally be sent on a weekly basis.  Following your completion of the course, we may send you other information very occasionally about other courses we think you might be interested in.  You can unsubscribe from this at any time.

Your Transfer Pricing Measurements Account

  1. Transfer Pricing Measurements retains the right to exclude access to online courses at its discretion.

  2. Your course access may be transferred to another party under certain conditions.

  3. You must use all reasonable efforts to keep your username and password confidential.

  4. You must not allow any third party to access the content using your username and password and make use of the content on your behalf.

  5. You must notify Transfer Pricing Measurements in writing as soon as you become aware of any unauthorised use of your Account, username or password.

  6. You acknowledge and agree that you are liable for, and will indemnify Transfer Pricing Measurements, its related bodies corporate, affiliates, officers, directors, agents and employees against, any and all claims made by a third party arising out of your access to, and use of, the Transfer Pricing site content.

SUPPORT CENTRE:

Use of the Transfer Pricing Measurements Support Centre (Support Centre)  is subject to the terms and conditions listed below.  You must agree to these terms and conditions prior to using the Transfer Pricing Support Centre.
The most important thing to be aware is that when using our services it is important to be aware that you, the client will retain responsibility for the essay and exam. We will provide advice and guidance on essay writting, structure and legal referencing, but validation of input data in benchmarking analysis, calculations and interpretation of results is the responsibility of the client.

Terms and Conditions:

1.    Disclaimer and limitation of liability.

a.    The output from the Services is believed to be accurate and current. However, the Transfer Pricing Measurements Support Centre does not give any representation or warranty as to the reliability or completeness of the output.  Nor does the Support Centre warrant that any of the functions contained in the output of the services will be error-free.
b.    The Support Centre shall not be liable in any way for any loss or damage, howsoever arising (whether in negligence or otherwise) out of or in connection with the provision of the Services except where liability is made non-excludable by legislation.
c.    The user must indemnify and hold harmless the Support Centre and keep it indemnified, against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from:
i.    any breach by the user of the General Term and Conditions; or
ii.    reliance by the user on any information arising from the use of spreadsheets provided as part of the Service

2.    Payment. Payments must be made monthly in advance by credit card if subscribing to a paid service.  Monthly fees will be deducted automatically each month on the anniversary date of joining.

Below is our confidentiality agreement.  In effect, by signing up with the Transfer Pricing Support Centre you have our assurance that your personal or company information contained in your models will remain your property, and will remain confidential.  We understand, however, that some companies have very strict security procedures and they may require you to remove data before sending the files to use.  That’s fine – we understand and won’t take it personally.

Confidentiality Agreement:

The  Transfer Pricing Measurements  Support Centre acknowledges that during the provision of support it will have access to and become acquainted with various trade secrets, inventions, innovations, processes, information, records and specifications owned or licensed by the User and/or used by the User in connection with the operation of its business including, without limitation, the User’s business and product processes, methods, customer lists, accounts and procedures.  The Support centre agrees that it will not disclose any of the aforesaid, directly or indirectly, or use any of them in any manner, either during the term of this Agreement or at any time thereafter, except as required in the course of this support with the User, unless otherwise authorised by the User in writing.  All files, records, documents, blueprints, specifications, information, letters, notes, media lists, original artwork/creative, notebooks, and similar items relating to the business of the User, whether prepared by the Support Centre or otherwise coming into its possession, shall remain the exclusive property of the User.  The Support Centre further agrees that it shall at all times preserve the confidential nature of its relationship to the Client and of the services hereunder.  The Support Centre further acknowledges that the information provided to the Support Centre by the User is the confidential information of the User and the Support Centre further agrees not to disclose that information other than to authorised representatives of the Support Centre  and that the Support Centre also agrees to be bound by the provisions of this clause and to maintain the integrity and confidentiality of the User’s information  Other staff engaged by Support Centre shall be bound by the foregoing duties with respect to User confidentiality.
